Removal and retention of vehicles (uninsured untaxed unlicensed drivers Foreign RV’s) Procedure

The Road Traffic Act 1988 (Retention and Disposal of Seized Motor Vehicles) Regulations 2005 and the Road Traffic Act (RTA) 1988 (as amended) provides a statutory authority for officers to ensure that uninsured vehicles and those vehicles driven by unlicensed drivers are removed immediately from the road.

In addition, under the Vehicle Excise Duty Regulations 1997 North Yorkshire Police (NYP) now has devolved powers from the DVLA to seize untaxed UK registered and foreign registered vehicles.

The owner of the removed vehicle may claim it at a later time but will be liable for the resulting costs of recovery and storage.  They will need to provide proof that the vehicle is insured and fully road legal prior to its removal from the recovery agent.
