Q1. Under the FOIA I would like to ask; Why has the decision of "NO Further" action been taken for the animal abuser [redacted] and local farrier [redacted]? Is it the police or the CPS letting this go unpunished? 

The drone footage we captured, Aug 2024, shows cruelty and abuse to a horse at the hands of said person. 

Decision
Your request for information has now been considered and North Yorkshire Police can neither confirm nor deny that it holds any of the information you have requested. To either confirm or deny that the information is held would disclose personal information and therefore be exempt under Section 40(5)(b) of the Act. To the extent that Section 40(5)(b) applies, North Yorkshire Police has determined that in all the circumstances of the case the public interest in maintaining the exclusion of the duty to neither confirm nor deny outweighs the public interest in confirming or denying whether or not information is held.

No inference can be taken from this refusal that further information does or does not exist.

Pursuant to Section 17(4) of the Act this letter also acts as a refusal notice in relation to the duty to confirm or deny.
