Request:
Thank you for providing access to your organisation's expenditure over £500 data, found here: https://eur02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.northyorkshire.police.uk%2Fpolice-forces%2Fnorth-yorkshire-police%2Fareas%2Fabout-us%2Fabout-us%2Ffinances%2Fexpenditure-over-500%2F&data=05%7C02%7CCivilDisclosure%40northyorkshire.police.uk%7Ce63e9001d2c14bb4b43c08deaa931edc%7C2c84bc9193af476e9721cdad67cb3ead%7C0%7C0%7C639135746739816485%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&sdata=zmVHj7B4eQg7LZoGd7S4k%2FC3HYO%2FyOikqEsHWaelzvk%3D&reserved=0
Q1. When looking at the dataset, I noticed there is no data currently published for October 2025 to January 2026. Please could you confirm whether there was no spend to report during this time or if the information is yet to be published. If it's the latter, please could I request access to the data too.
Response:
Extent and Result of Searches to Locate Information
To locate the information relevant to your request searches were conducted within North Yorkshire Police.
I can confirm that the information you have requested is held by North Yorkshire Police.
Decision
I have today decided to disclose the following information to you.
Q1. I am exempting this information pursuant to Sections 21 and 22 of the Freedom of Information Act 2000 (the Act) on the basis that it is reasonably accessible by other means and intended for future publication, using the below link:
Expenditure over £500 | North Yorkshire Police
You will see that the data for October and November 2025 is currently published, with data for December 2025 and January 2026 expected to be published in the near future.
Exemption Explanation
Section 17 of the Act requires North Yorkshire Police, when refusing to provide such information (because the information is exempt) to provide you the applicant with a notice which: (a) states that fact, (b) specifies the exemption in question and (c) states (if that would not otherwise be apparent) why the exemption applies.
Section 21 – Information Reasonably Accessible by Other Means
Section 21 is an absolute class based exemption and I am not required to consider the harm or public interest when applying this exemption.
Section 22 – Information Intended for Future Publication
Section 22 is a qualified exemption subject to the public interest test. We have considered the public interest in releasing the information against the interest in withholding it. There is a public interest in transparency being demonstrated by releasing the information with this reply. However, transparency is also achieved by North Yorkshire Police publishing this information on their website. Providing this information in response to an FOI request is not the most cost-effective way of placing this information in the public domain, when it will be published in due course on the North Yorkshire Police website. The exemption under Section 22 of the FOIA recognises that it must be reasonable to withhold the information until the date of publication. Given the necessary preparation and administration involved in publishing the information, we have concluded that the public interest in withholding this information outweighs the public interest in releasing it.
Pursuant to Section 17(1) of the Act this letter acts as a Refusal Notice in response to your request.
Please note that systems used for recording information are not generic, nor are the procedures used locally in capturing the data. It should be noted therefore that this force’s response to your questions should not be used for comparison purposes with any other responses you may receive.
